Hello I am looking for some qualified advice on an issue of “intellectual property law”. I am a small business owner and I registered a Ltd company in the UK in 2007. The bank account was also set up and used. In a very short time later I had found that a Multi national company (Firestone) had introduced a product into the UK with the same name as my registered Ltd company. I have a roofing company, their product is a flat roofing product. My company name was not trademarked. Their advertising of product absolutely sank the position I had on google etc due to the ferocity of their campaign. I’d had letters from their UK solicitors accusing me of infringement but my representatives proved them to have no case down to dates of registering etc. My question is… Is there a way forward legally against the company or is it a case of live with it? I am looking for sound and solid advice. EDIT>> I feel ive not been clear in the description, The case that was brought against me by interlectual property law was for "passing off", of which was proven unfound by a solicitor I used. My question is.. is there a way that this could be counter claimed due to them bringing a product to market named the same as my company? Thank you and apologies for not being clear at first.

Car gearbox issues following work
Had some work done to my gearbox on car with 2 sensors fitted as aftermarket product and software as original no longer avaialble. Car was OK for a few months. Then started jerking a few week ago 3 times. Took it to my local different garage as where I had work carried out is 70 miles away with company called AP. When at garage the gearbox stopped working. He pushed garage onto ramp and oil was coming out of it. It ended up being the gearbox oil where it was taken apart from initial garage AP. All oil had drained and this resulted in the sensors of gearbox being "locked" He showed me oil leak and initial work not carried out to a good standard as the pipe was leaking and seal damaged where initial garage AP carried out the works. He said will get a new pipe and calibrate the gearbox software as well as latest software updates Saturday 13th. On Monday 15th pipe replaced but software could not be updated a she said 3rd part part and only initial garage where part replaced could fix it. Cost me additional £600. So car was taken away by intial garage[AP] and on Friday 19th I phoned for an update and they said sensors working OK but car will not drive and that where I took the car to get the pipe fixed had "corrupted" the software. Told him no way possible as the software they are using had been used many times before on other cars, constantly updated, not 3rd party software, garage paid over £20k a year for licence from the main dealers as all linked to its mainframe HQ PORSCHE computer. He said a technician wil ring me. The car was pushed onto ramp as no gears were working and this was even before the software was plugged into the car. So what AP garage said was a total lie and placing the onus on my local garage. I phoned my local garage and told him everything and he was not happy. He said car should have left AP garage with calibration and software update and they did not seal the pipe properly hence the leak and software locking and car not going into gear so no gears and evident by car being pushed onto ramp He said ask AP to give his technician [Mark] a ring on Monday. I initially paid over £6k to get 2 sensors fitted to the car in October and it drove ok until a few week a go and even drove better after the work but there was an oil leak and I thought it was just from the engine as was evident before but was from the gearbox. Need this to go to legal if they refuse to claim liability.
