Hi I am looking to get advice also help to take a case to court.
I was employed by a company called Brit security management. I worked as self employed but they also gave me weekly hours, uniform and a company car. 5th of each month , I send my invoice and get paid on the 15th.
October last year was my last month with the company. I left because they took money out of my invoice without informING me. The problem was, i finished my shift and i left the car keys under the car sitt inside the car as we always do. The next security guy couldnt get into the car so they had to call lock smith. So they dicduct £80 from my pay without telling me so i quit. The problem now is , I wasn't paid my last invoice of £689.
I went away for few weeks , I wasn't aware that they didn't pay my October invice until I came back on November ending. I contacted them few times by e mail and post but there was no reply. I called few times and I was told the boss was away. One day I managed to speak to the boss around November, he told me that I wasn't paid because they are still thinking of how much to take out from my pay because of the way I left the job. He also said that I will receive a letter explaining.
I didn't sign any contract with them. After a month I didn't receive letter or my pay. I sent few e mails and also called but I couldn't get to him. It's was like he is avoiding me. I was advice to contact acas which I did. Acas managed to contact them and within 2 days they sent me a letter saying that I have been charged £500 for 2 accident and £100 for unrefined uniform and another £80 for locksmiths.
I have never had any accident ever while working for them.
Secondly they are diducting another £80 for locksmith and they forgot that they have already done that in my September invoice which was the reason I left the job anyways.
I have spoken to acas regarding the last letter they sent me. Acas has tried to contact them to provide more information about the accident but they are nto talking to acas. Acas has advice me to take it further to court but before I do that, I need to get professional advice on which court to take this case. Tribunal will be my first option but I'm not sure if they can deal with this sort of case since I was self employed. Even though the company has more power over me.
Please what is the best advice and best way to recover my money as this has cost me so much pain and stress.
I will pay what ever it cost.
