Description
Experience Level: Intermediate
I would like a quotation for someone to look over my entertainment/event contract and make sure its correct.
I have already show this to a friend of mine and he said the following comments,
"Terms and conditions are a very subjective issue and he only advice you should take regarding them would be from a solicitor that specialises in entertainment agencies and artist's performances. You can include stuff that you believe protects you but section 5 in particular is hardly ever likely to be upheld in a court because it is nor fair and balanced to both parties to the contract. It is unreasonable to expect a party host to be responsible for the actions of a guest. Likewise your client will have no control over access to a venue or their lighting or house-keeping practises. So get this checked by a professional and show it to potential clients before you adopt it. The client needs to be protected, especially when it comes to item 16. Their privacy also needs to be considered. You also need to avoid the use of vague or general phrases. Be specific when you stipulate requirements like space and electrical supply. The more specific and detailed your requirements are the better they will be understood by your clients.
I am not sure if any of this is correct but is this something you can potential look at for me?
In a ideal world this will also cover me for dry hiring equipment I have attached an example of another companies terms and conditions for this.
On another point regarding privacy policies and terms of service I would be using a third party service to take booking and event information. Here are some examples of information I will receive: Home address, telephone numbers, emails, name of guests, interests, ip address, age etc.
I have included it as a attachment I know what I have done is not correct so if you could quote both jobs separately that would be great.
Many thanks
Matt
