Description
Experience Level: Expert
Job Description
I am looking for a UK-qualified intellectual property solicitor with experience in trademark enforcement and the Intellectual Property Enterprise Court (IPEC).
I own and operate the Butlers in the Buff brand in the United Kingdom and hold the registered UK trademark for this name.
A separate business operating from butlersinthebuff.com in North America is using the identical name and their website is appearing in Google search results for UK users searching for the brand. This is causing confusion for UK customers and is affecting search visibility, including Google AI Overviews and Google Business Profile rankings.
I have already attempted to resolve the issue directly and have issued a Letter Before Action, but the other party has refused to make changes and has stopped responding.
I now require a solicitor to review the situation and assist with the next steps.
Scope of Work
Initial work required:
• Review trademark position and correspondence
• Advise on the strength of a UK infringement / passing off claim
• Draft and send a formal solicitor letter to the other party
• Request corrective actions to prevent confusion in the UK market
Potential follow-up work:
• Preparing documentation for a claim in the Intellectual Property Enterprise Court (IPEC) if required
• Advice on enforcement options and strategy
Information Available
I can provide:
• UK trademark registration details
• Email correspondence with the other party
• Letter Before Action already sent
• Evidence of Google search results showing confusion
• Details of a previous court case involving this trademark
Ideal Experience
The ideal solicitor should have:
• Experience in UK trademark disputes
• Knowledge of online brand enforcement and SEO-related trademark issues
• Experience with IPEC proceedings
• UK-qualified solicitor or IP specialist
Budget
Open to proposals for:
• Initial legal review and solicitor letter
• Ongoing work if the matter proceeds further
Additional Notes
This is a UK trademark enforcement issue where the primary goal is to prevent confusion in the UK market and protect the brand rights.
Please include details of your experience with similar trademark or IP disputes when applying.
