(FYI: For this piece of research, its possible that the theory I am looking for evidence to support is wrong, and hence stars are given based on the quality of the research, and not if the results of the research are negative. i.e. if your research proves the ideas below wrong, then that is good research also...)
Details:
I would like a researcher to summarize the relevant UK (England) legislation regarding domestic noise pollution from part 3 of The Environment Protection Act 1990 (EPA) with regard to the obligations of local council authorities.
I'd like to contrast that with the procedures and rules set out in my local council's published document "Nuisance Information Pack". (attached)
My local council require that members of the public making a statutory nuisance complaint need to complete 3 weeks of diaries recording all incidents of noise, and to characterize those incidents in depth. I feel that this is an incredibly onerous requirement given the context.
It is implied by the council documents that if these steps are not followed, the council cannot legally, or is somehow prevented from considering the statutory noise report.
I contend that the act sets out that obligations, such as to deal with "anticipated" future noise, periodic noise, such as school holidays or bank holiday weekends, or other circumstances where the request to keep a 3 week noise diary is not be appropriate.
Hence I would like a researcher to summarize the obligations from the Act, and then to determine if the steps required from members of the public to make a complaint are consistent with those obligations.
Obviously, I support the steps of the environmental protection team to reduce spurious complaints, but I feel that particular requirement goes too far.
I am looking for a short document which reports on those ideas.
