Description of legal work: Have been struggling with a sole trader supplier for 1 year, need to take advice and possibly prepare for legal action.
Extra notes: I engaged a specialist sole trader (freelancer/contractor) to develop a prototype for a new security camera which is a project that we took on for one of our own existing customers.
The first few months of the project went well but then the contractor started to go missing for periods of time, not reply to emails or answer phone calls and progress with the project begun to slow down and we have been struggling with him for the last 6 to 9 months.
There is no written contract for this project, although he did originally provide a proposal, project plan and take a 50% payment for the project upfront which was paid before he started the project.
For the last 6 months there has always been some problem/issue/excuse with the project that has delayed him completing it and for the last 2-3 weeks the camera has supposedly been stuck clearing customs in the US - I may be wrong but I don't believe this, I have asked 3 times for him to provide proof that the camera is stuck in customers and each time he has refused to discuss or provide the requested proof.
I found out recently that he was previously a director of 2 companies that closed with debts and that in the last 2 years he has clocked up 6 CCJ's the last one of which was in February 2014 for £10,500.
If he doesn't deliver I am, likely to loose my largest customer, and redund them the money that's been paid to him to date. Given what we know about his financial record I suspect any claim for money would be in vain however I am wondering what options there are for getting a court to force him to complete the project or force him out of business/stop him trading as a sole trader?
