Co-habitation legal challenge
Female friend in legal dispute with male who is claiming 50% of assets (house, etc) on the basis that he had man/wife relationship for past 17 years. No agreement in place and couples lived separate lives. He appears to be acting without major costs - letter from Mediation charities, and now B136 notice of application to register a restriction against the land.
It is acknowledged that person did initially have relationship for first 4 years but then as lodger only. Unfortunately claimant retained all receipts (house odd jobs, ad-hoc repairs etc), rent cheques (paid only occasionally) • and on this basis has long list of charges • although the majority of costs incurred were reimbursed • usually with cash • with no receipts. But appears to be seeking 50% of home.
Claimant was penniless, no home etc so this friend let him continue to lodge. Never married or planned to, was not wanted by her family, or invited to weddings, births etc.
Local solicitor on appointment has immediately requested a note of his list of costs/requirements • not sure if this is the right approach • as apposed to rejecting his claims?
Defendant has suffered badly this last year with loss of daughter etc and now ex-partner seeking half of house etc - difficult situation to face at this time of year. Has lengthy statement to show strong case - he has retained photos etc and claims in recent emails - dear wife and step-daughter etc - almost construed to show relationship was in place - almost deceitful in approach.
Ideally person with strong family legal dispute background and local to Formby, Liverpool • not for the faint hearted!
