I have over a decade of experience helping clients achieve valuable trademark registrations, including overcoming challenging refusals by the United States Patent and Trademark Office (“USPTO”), and enforcing those rights against unauthorized third-party users. I strategize with the client to determine what goods and services should be covered by the proposed mark, including those that the client intends to offer down the road (but is not offering currently); how to describe those goods and services in a trademark application to provide the client with the broadest protection while avoiding refusals based on descriptiveness and likelihood of confusion with a third-party mark; and for those marks that are currently in use, I obtain a specimen of use that should be accepted by the USPTO. I then prepare the application for the client's review, make any necessary changes, and file the same with the USPTO. There is significant strategy involved in preparing a trademark application. It needs to be prepared well the first time because if not, the application will need to be abandoned and started over at substantial cost and delay to the client. Businesses invest a lot of money in research and marketing and need to feel secure that they will not need to rebrand down the road due to potential infringement issues or difficulty and expense obtaining a registration that will allow the business to grow. I have this experience, even overcoming a descriptiveness refusal to register the EDIBLES mark for baked goods. I think outside of the box to obtain the protection my clients rely on and would be thrilled to offer the same to your business. The cost associated with this offer does not include the filing fees charged by the USPTO, which range from $350-550 per class of goods/services depending on the manner in which the goods and services are described. This offer also does not include a clearance search to determine risk associated with the use and registration of the proposed mark, which I highly recommend for all filers. I can conduct this search for an additional fee. This offer also does not include services beyond the preparation and filing of the trademark application. The USPTO often will require issues to be addressed to see a mark to registration. I am available to assist with addressing these issues and will provide a cost once the issues are identified by the USPTO after examination of the application (usually about 6-8 months after the filing date).
