Uniform Domain Name Dispute Resolution Policy (UDPR) allows an exception to the basic principle of ‘first come, first served’ basis when three criteria are satisfied:
a. that name is identical or confusingly similar to a trade mark in which the complainant has rights over;
b. that the current holder has no right or legitimate interest in the name;
c. the name has been registered and is being used in bad faith.
The remedies available are either to ‘cancel, transfer or otherwise make changes to the domain name registration’, assuming that it has violated a policy.

Basically, if someone has taken a domain name and it is identical or close to yours, or has been registered to sell it to the right owner (you), then the domain name following a dispute filing, can be transferred to you.
