Angela and Mark Williams are married. Before this, Angela was in a relationship with Ryan Cresswell and they had a son Freddie Williams-Cresswell (now aged seven). Freddie still lives with his dad Ryan and his new wife Sienna Cresswell.
Angela and Mark are having marital difficulties. Mark strongly believes that the function of marriage is to bring up children and wants to have children with Angela, but he is infertile as a result of chemotherapy when he was in his teenage years (he was told when he was seventeen that the chemotherapy would lead to infertility but it didn’t really matter to him at the time). Their only option for a child of their own is donor insemination but the couple are both strongly opposed to Angela giving birth to another man’s child. Mark has become severely depressed as a result of his infertility and the arguments it causes at home.
Mark has visited his doctor in the last three weeks about “dark thoughts” he is having about “how much better the world would be without him” because he “can’t do what a man should be able to do which is have children”. The doctor makes a note on Mark’s medical record that he has been diagnosed with depression as a result of his infertility and its effect on his mental state and relationship. Mark has refused to take any medication despite being prescribed a common anti-depressant drug.
Angela receives a letter from Ryan through the post one morning (three weeks after Mark visited the doctor). This is not unusual - Ryan often sends photos of Freddie to Angela along with samples of his excellent school work. Angela can tell it contains a photograph so she puts the envelope on a table, planning to open it later. Unfortunately, before Angela can look at the letter Mark opens it. It contains a photograph of Ryan, Sienna, Freddie and his new baby sister, Georgia Cresswell. Mark is deeply upset and jealous about the perfect family picture, so he rips it up and puts it in the rubbish bin in the kitchen. Previous family photographs of Freddie and Angela together have also caused a very negative reaction in Mark, making him brood for days.
When Angela returns home that night she cannot find the letter and asks Mark where it is. Mark tells her he has destroyed it because he cannot bear to have pictures of Freddie in the house. Angela is furious and exhausted with the situation, and screams at Mark that she is leaving him, muttering that “a real man would be able to give her children”.
Mark runs up to Angela in a rage and tightens his hands around her throat, pins her to the living room floor and strangles her in violent shakes for well over thirty seconds until she turns blue. Mark clambers back onto the sofa only when he realises that Angela is unconscious and decides to call an ambulance knowing that he will be arrested for a serious offence, but doesn’t know what else to do. The paramedics arrive and check for a pulse as a police offer arrests Mark. He has not had any alcohol or drugs. It seems Angela is dead, but the paramedics continue to try to revive her in the ambulance on the way to hospital. She never regains consciousness and is pronounced dead on arrival at hospital.
