Hi, i need some advice from an employment solicitor for the situation as follows:
I have resigned from a company that i have worked for for the last 10 years, due to my role involuntarily devolving from a position i was ok with, to a position i wasn't happy with at all... It has been 3 weeks since i have handed in my notice, and i have now been the subject of an accusation of an alleged "Breach of contract" as i have allegedly set up a company or worked for a company in direct competition with them... The basis of the accusation is an alleged tip off from an anonymous source.... The company in question was setup by one of my friends, and now the acting director has the same surname as me...... As a result, i have been sent a letter of "Cease", which informed me they would be sending a letter of "Cease and Desist" to the company and its directors.... They also mentioned that they may not pay my salary that is due for the month i have worked, along with any holidays and notice period..... I have checked my contract and although the clauses regarding "non compete" are very clear, i do not think they are enforceable for the following reasons:
1 - I have suffered a motorbike accident and i am not mobile, or able to attend a place of work. So looking for alternative jobs will be extremely difficult as they would be limited to jobs i can do at home.
2 - I do not have any formal qualifications.. I only have my 10 years of experience working in the industry, so if i am not allowed to work for a competitor, or set up my own company of a similar nature, i really have no options but to stay at home and claim benefits.
There is also cause for concern because it transpires that my employer has not actually been making regular contributions to my pension (i am waiting for the full report for further details) as required of them.
The work i have been doing for them has all been remotely with my own computer and equipment, which is largely unmonitored which is also a breach of GDPR as they are not ensuring their data is protected at all.
I am hoping someone can help me out here because i have bills to pay, a car that i need to fix so that i can mobilise and 5 further surgeries which i need to prepare for and i would rather not claim benefits.
