Description of legal work: We have received an online small claims court for £6000. Claiming breach of contract and particulars of loss.
We did work for this client in 2014( Rear extension and loft extension). Building Control office BCO ( private firm) asked for smoke alarms to be fitted to all the rooms and hallway common parts 3 floors. We asked him for additional sums as this was not part of our works. The client came back saying that he spoke with the Merton Council and they said he does not require the smoke alarms as requested by BCO. Upon completion of the works we could not supply him with the Completion certificate as he was liaising with council on the matter.
In Dec 2014 we received letter from his solicitor claiming breach of contract for failing to supply Building Control certificate and cost of relocation boiler to a 'safe' place. This was the first we heard about the boiler. We installed as per architects drawings and there as no mention on any of the Building control officers reports. We have no idea what the issue was regarding the boiler. All we have is this costs to move boiler to a safe place. As a first, we should have been told what the issue was, secondly, give us the opportunity to rectify the issue if it was our mistake.
