I have drafted an indemnity contract, and I would to have it checked and rewritten if necessary.
My sister's partner has left her and my sister will lose her flat unless I help her with her mortgage reapplication (her income is too low to reapply alone). My mother cannot be guarantor, as she is 70 and the bank do not accept retired guarantors. But my mother will help my sister pay the mortgage. She has enough in investments to do so, but doesn't want to buy the flat outright, because of the capital gains tax bill from liquidating her assets.
I do not really want to sign onto a 30 year mortgage (it was my mother's idea), but I am willing to do so to help my sister.
I would like my mother to sign an indemnity contract, saying that she is responsible for any loss or repayment to the bank if something catastrophic happens to the flat (my mother has enough money, apparently, to do so). For some reason she refuses to go through a solictor, and insists we can draw up the contract ourselves.
I have drafted a contract but I would like a legal professional to look it over, and rewrite if necessary. Is this a service you offer?
