Trademark question:
Registered company is called "Greenflush" and wish to create a resgistered trademark brand called "exceed water" for product we manufacture for class 11, for example.
A company already exists called "exceed water" registered for 17 years with trading history with no recognisable logo, brand, website or trademark and operates in class "96090 - Other service activities not elsewhere classified"
What are the potential issues - trying to avoid paying for a trademark/loss of time which may be automatically rejected- Worse case is we re apply but some quick solid advice would be helpful.
Please only respond if you're familiar with this situation.
