I have a limited company and some 3 or 4 years ago we loaned jigs and moulds to a limited company in a joint project. They would develop the product so that it could be relaunched to the market but paid no actual price for the equipment (sweat equity)
We signed a deal with his limited company and I was made a director when the deal was signed. However nothing happened and no development took place. The partners of this company split and the remaining director then closed the limited company without telling me and therefore the deal we had was nulified.
One of the two people wanted to continue with the project but again nothing happened and when trying to trace our equipment there were a trail of unpaid storage bills for our equipment. We know that various storage owners had our equipment removed and destroyed due to unpaid bills, but they wouldn\'t know that we were the ultimate owners. All the equipment in their physical possession has been destroyed/stolen/lost.
His partner has backed my claim and says he will do what he can to enable me to get compensation.
I have written to him and made it clear that I want £24,000 as compensation of the items and this reflects only the cost that we paid for them (have receipts)...I know believe this amount should be £30k based on identifying other equipment missing.
We have also missed out on the income that copuld have been achieved and the cost to replace these items is far higher than the actual cost of £30k even.
I want to move on and settle out of court. I have offered terms that requests £6k (with repayment terms over a year) plus two incomplete vehicles that he has and would be useful to me in trying to arrange a new business project (and thes vehicles also relate to the project we were meant to be undertaking together).
He has sought legal advise and called me to verbally accept those terms but now I can\'t get him to take any action them.
I want to initially send him a solicitor\'s letter and warn him that I intend to take this to court via \"Money Claim Online\". This project is specifically to provide a letter that can be sent officially and therefore assume it can be on a fixed fee.
Can I have also have an indication of approach and likely costs to take this further should it be required.
