I need someone, with legal qualifications and specialisation in the property sector, to answer a question with regards to the “second bite” provision, covered by clause 171B (4b) of the Act and how that relates to a specific Enforcement notice that was served (incorrectly) 9-years after the LPA became aware of the alleged planning breach and then not correctly served until 16-months later, which was, by then, 11-years after the LPA became aware of the alleged breach and, consequently, out of time.
If this is an area you can assist with, please let me know and I will send you a (brief) background. I then simply need to know if this second-bite provision does give the LPA a ‘get out of jail’ card?
