Description of legal work: Hello,
I have purchased a travel pillow from China that is exactly the same as the trtl pillow. However, I have branded my pillow with my own brand. I have around 800 still to sell, and Amazon.co.uk have blocked my listing. On doing a search of Amazon.co.uk I can see that EVERYONE selling the pillow has been blocked, other than trtl. However, on looking again this morning ONE of the other sellers has cropped back up again.
I need someone to look into the patent and see if there is any market that I can sell my remaining stock in. I did a little research and read that there is a difference between an "issued" and a "published" patent, and looking at the report I've just received it looks to me like their patent is not enforceable worldwide yet because the publication number has the year in it. It looks like Canada, China and Europe markets are enforceable as the publication numbers do not include the year. And it looks to me as if the USA market is NOT enforceable because the publication number has the year in it!
I'm looking for someone who can confirm or deny the above, but please, only if you know 100% for sure, because I don't want to spend more money shifting my inventory to Amazon in the USA only to have it blocked again. I'd also like to know that if my understanding above is correct then how much time do I likely have to sell on Amazon in the states before the patent becomes enforceable?
