Description of legal work: Hi,
I am in the process of transferring FULL ownership of my property to my parents for a stated consideration value.
I have now completed the relevant forms (TR1, AP1, ID1 (including verification by a conveyancing solicitor) and Stamp Duty form (including obtaining an SDLT5 Certificate)) but would like someone to carry out as follows:
1. Review of TR1 form (although I'm confident about it's content with the exception of the below)
2. Suggestion of the need for and, where appropriate recommendations of covenants (panel 11)
As I have said, this "should" be a simple transfer and the vast majority of work is done. Furthermore, I am looking for advice (only). If I choose to take the advice, it is of my own doing and there will be no liability on your behalf (unless of course you advice results in an illegal declaration, fraud etc.). I intend to file the forms myself and would not be looking for you to submit anything which was not of your own doing or work (I am an accountant and hence have a good understanding of contractual matters, the giving of advice and prospective negligence).
I will supply you with a copy of the form and a brief overview of the transaction (including any supporting forms / documentation you may require.
Finally...
I'm not expecting this to be a big job or one that will take excessive amounts of time. The inclusion of covenants is purely to ensure the legalities are covered and do not cause issue for later sale. The intention is that my parents will sell the property in 5 years and hence, I don't want to make mistakes now that will cause issue on resale. However, I'm not majorly concerned about my parents having a level of comeback on me for missed indemnity clauses!
Extra notes: In addition to the above, I am happy to supply a copy of the TR1 form for analysis and to enable you to provide an educated proposal value. Clearly, at this stage the form will lack some the finer details as I will not be sharing the true facts with anyone other than the successful applicant.
Before I send you the "draft" TR1, I would like you to give some information in a proposal first including:
Your Name
Practice Name (where you are a legal professional)
Experience and nature of your conveyancing knowledge (i.e. as a conveyancing solicitor, property accountant, consultant etc.)
Your expected price (including any assumptions or caveats you have made in providing that proposal)
