Description
Experience Level: Entry
Estimated project duration: 1 day or less
General information for the business: Property law - UK Solicitor/Barristers only please
Industry: Legal
Legal topic: Property
Description of legal work: Property law tenancy agreement query - fast response required.
Extra notes: A colleague of mine has a tenancy agreement with a 6 month break clause for a house she has.
The tenant is a nuisance and she wants to get the tenant out at the end of the tenancy agreement (one year agreement). The agreement states 2 months notice is required in accordance with s21 Housing Act 1988.
The tenant stated before she moved it that she would sign the agreement and give back the originals etc to the Landlord. However, the tenant only signed the schedule of condition section. She did not sign the signature page. However, she moved in January 2014 and has been paying rent.
I have a few questions about this and will need any relevant caselaw/legislation to back this up in case the tenant creates a problem (which I am sure she will).
