Need advice from a legal professional on how to resolve a dispute with a trader.
I had a problem with my file storage server and found a specialist to recover data from its hard drive. I got a price online which was £99, which I accepted. I sent the server to them for recovery but then the quote increased to £500, which I declined and asked to return the server. However, the company only returned the broken hard drive and disposed of the server appliance. I complained, but they said that the server wasn’t worth much and according to their T&C’s they can dispose of it. However, that wasn’t obvious from their T&C. After arguing with them for a few days, they offered me a replacement. I agreed to accept it provided that it will work with the new hard drive once my data is transferred from the old one. However, the server manufacturer said that I would only be able to access my data when the drive is installed in the same make and model. I asked the trader to either provided a new/used replacement of the same make and model or cover the costs. They refused both.
I sent them a pre-action letter and suggested alternative dispute resolution but they are just ignoring me. I need to understand if there is a way to resolve the issue without going to court or if that’s the only option left, I need someone to check my particulars of claim, which I will draft (no more than 2 pages)
