We are a UK based company and create new products. One of our products was sold off by the shipping company (due to a delay to obtain dcuments from the shipper in Far East) to a competitor who intends to market the products nation wide.

We own registered trademark on the product. The photographs taken on the product cover and other printed material are copyright as we took them and have proof of the same in form of contracts with the photographers. Parts of the products itself is protected by unregistered design rights.

The company has started to sell the products already and are not willing to return the goods to us despite a letter stating the facts and continue to sell the products.

We are looking for a solicitor with experience in IP to pursue a claim for damages in view in breach of IP rights. We have run the case past an IP solicitor and there is clear cut breach of IP rights which will be easy to prove.

Preference will be given to people willing to work on an NO WIN NO FEE basis. Legal cost can be recovered from the other party easily (they are a big firm). Additonal revenue can be generated as a percentage of damages awarded (in additioin to legal fees) for those opting for a NO WIN NO FEE basis.
