Landlord has failed to register my deposit, been 6.5 months.
Was a 6 month AST which becomes a rolling monthly on-going after the initial 6 months period.
Landlord also failed to give me my copy of the AST.
I do, however, have proof of rent payments, as a signed letter, and also proof of residence as my TalkTalk bill at the address.
Landlord was not allowed to rent the property as it was not in a habitable state (full of damp) and the local council were still waiting for a valid damp course certificate from him, which he never supplied because he had not had the damp course done!
That was also the reason he had not given me the AST copy and in fact was very reluctant to give me the signed letter for the same reason.
He subsequently (at month 6.5 into the tenancy) drilled the locks and gained access to the property, without my permission and without serving any notice. I have a video of this as I was driving by and entered the property while the locksmith was there.
He also has some of my possessions there and is refusing to return them. He also has a £550 deposit which he has still not attempted to return.
I was also not given a gas safety certificate. There are no smoke alarms or CO alarms at the property.
I am claiming for
(1) Failure to register the deposit (£550) - claiming £1650 (3x)
(2) return of my deposit (£550)
(3) damages for illegal eviction (no notice served)
(4) damages for holding onto my possessions and refusing to return them
(5) Actual damage to my locks that cost £80 each (x2). as he drilled these. I would have had his original locks refitted when I vacated but he forced his way in by drilling my locks
(6) Damages for using my gas, as he previously entered my property many times, without my permission and turned on the radiators and heating to try to "dry out the damp walls". That was the reason I eventually changed the locks.
(7) A month into the tenancy he had a major flood at the property as the main drain was blocked and water flooded the kitchen and lounge, damaging some of my possessions. Damages for that flood damage
(8) return of some of my rent, as the property was not habitable and has caused me breathing problems and asthma due to the constant damp issues.
All my rent was up to date as of 1st June. I would have cleared the final rent amount also once he had returned my deposit to me. He drilled the locks on 7th June. I have not been back since.
I need a solicitor / legal professional to write an initial letter of my complaints to the landlord on his/her own letterhead, explaining what I am claiming to give him a chance to respond.
Liase with him, by post, to clarify what he agrees with and what he disagrees with.
Write a final letter before legal action, unless he agrees to pay.
Help me to file the small claim (will be below £10,000 total claim)
I will attend the small claims hearing myself.
I have a log of all the events that happened (and dates) and a list of what happened, so it will not be a lengthy process to sent the letters and file the claim.
You MUST have your own letterhead and address to be able to enter into correspondence with him.
Please give a fixed price quote for the entire job.
