1. Alf, an employee of Skimpy plc, is seriously injured whilst working in the factory on a machine which is not guarded. Contrary to instructions, Alf had removed the guard to make it quicker to work on the machine.
Skimpy plc had bought the machine from Hitech plc because that company had guaranteed that the guard could not be removed.
Ethel asked to be allowed to stand in and do Alf’s job on the machine while he was off work with his injuries. She was told that she could not do so because ‘it was not a woman’s job’.
Required:
(i) Briefly explain the civil and criminal cases which could arise from these events;
(ii) State, with reasons, which court or other body would hear these cases.
2. Explain, with reference to cases, how the law could make an accountant liable to pay compensation in the Tort of Negligence for giving negligent advice.
