Draft a set of : Finance Broker Terms and Conditions
We need some terms and conditions writing up for clients to sign up to or acknowledge that we are a finance broker company (non-regulated) for Business to business only financial loans in excess of £25K. The terms and conditions must be standard for finance brokers who liaise with both lenders and clients wanting to borrow funds. Key aspects should include :The broker obtaining the funds for the client’s behalf but the client being fully responsible for repaying the loan and acknowledging that they are responsible for completing the application and fulfilling the criteria. The T&Cs protect our business and limit liability from any claims relating to obtaining finance from the client or any third party relating. The broker will take a commission or other similar fee for our services direct from the lender which needs to be incorporated into the document for transparency purposes.
We already have T&Cs for our consultancy business – which we can send – this business serves a separate function to finance acquisition for clients and relates consultancy business advice and guidance for a retainer fee. It could be that these T&Cs are extended to include the finance broker service but explicitly so in order that clients can see the whole range of business services on offer.
The T&Cs are for CBS Finance which is a trading name of Commercial Business Solutions Ltd.
