We have a son who is Statemented under the Special Education Needs Act, and have been informed that he is excluded for a period of ten days. He has already had other exclusions for fixed periods of up to three days. The reason for his exclusion has been because he refused to follow instructions, used inappropriate language towards students and swore at members of the Senior Leadership Team. Our son denies all of the above. Almost all the exclusions that he has had in the past, give the same decisions as above. Our son has MILD Learning Disabilities that include Language and Speech Difficulties, Developmental Delay and Myopia. He has been previously diagonised with ADHD and Autistic Spectrum Disorder and later on, these were ruled out at the age of 5 or 6. He is not a suitable candidate for a special school because his needs can easily be met at a mainstream school as they have always been. Back in January 2011, we requested that the school involves an Educational Psychologist in order that his needs are re-assessed and we were told that they will arrange one for February but we have not heard any further other than that they are now seeking his removal from school permanently by speeding up the number and days of exclusions. This Academy is failing to strategize an effective intervention that works and make adequate assessments or allow an Educational Psychologist to do so. There is many more other issues involved to be explained later on.
We are therefore seeking someone to represent us at the schools Descipline Committee (School is in Hockley, Essex) as this is an Academy School and also as we are confident that the exclusions relate to the disabilities that our son has, we would like someone to present this case to the \"Special Education Needs and Disability Tribunal (SENDIST).
Our son is now in year nine, 13 years old and has been at the Academy since the beginning of his secondary schooling.
