Overview
EU and UK law has changed in relation to data protection and tighter regulation for getting and recording ‘consent’ for contacting people.
Historically, companies would put a small tick box on the terms and conditions to say - you agree to be contacted. With the new regulation, this is no longer sufficient consent. People now need to double opt in consent.
This involves clear and obvious articulation of the fact they will be contacted, by confirming by ticking a box or pressing a button. Which then results in an email being sent to the person, confirming the details - example ‘You have consented to being contacted by ….” then having a button or link to confirm consent again. This is double opt in consent.
Scope of work
I am looking for a document/blog that clearly defines and explain the new EU regulation in relation to GDPR and specifically focused on the ’double opt in’ .
Points to be covered
- Clear articulation of the scope of the problem. ( all the contacts companies have, are not legally consented for contact.)
- Clear articulation of the new law and guidance, quoting official GDPR / ICO sources like;
http://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32016R0679&from=EN
https://ico.org.uk/for-organisations/data-protection-reform/overview-of-the-gdpr/key-areas-to-consider/
- What’s changed in relation to the old way - simple tick box confirming consent, Vs ‘Double opt in’. I am looking for a clear and simple comparison of the old and new - high lighting new requirements.
- We need to find evidence/wording with links or quotes, to show that companies can be audited and will need to prove with audit - their compliance.
This work, may form a blog, but mainly will be used as an education aid, to promote a new solution to fix the problem,.
This will ideally fit on an A4 page, allowing room for branding and maybe images.
I would ideally like this today, definitely by the end of Sunday.
Any questions, please ask.
