I have a private client who is conducting civil litigation. He expects that the matter will settle and wants to be in a position to consider the tax treatment. He is also considering whether to assign the benefit of the litigation to a company, so that the company would be taxed (if it were deemed taxable) rather than being taxed in his hands.
