I provide web design and marketing services to clients in the UK. I have an issue that has arisen from a client whom I ceased working with in October 2011.
We ceased working together in October 2011 due to differences of opinion and as far as everything seemed, we had an amicable split. I provided the client with instructions for moving her websites to a new hosting provider and even offered to assist with this if required.
In September 2012, I noted that the client had still not moved her websites so sent her a polite letter to ask her to do this as quickly as possible. I took no action at this time as I considered the client to have been a friend during our working time together and I'm not a vindictive person.
In March of this year, when performing a spring clean of our servers I noted that the client had still not moved her websites. As we had no working relationship (or contract) in place and I had received no reply to my letter 6 months earlier, I removed the websites from our server to make room for new clients.
On May 1st the client called me to demand to know where her websites were. In the process of explaining that she had no active hosting services with us as this would have been additional costs, she hung up on me, telling me she would see me in court.
I was perfectly happy to, and still am, to provide all website files to the client on CD.
I received a letter last Thursday, dated May 1st, with a note on the envelope about delivery to wrong address. The letter requested all website files on a CD in 7 days or the client would take further action.
I took Tuesday morning off work to prepare a disc but did not get an opportunity to post it as I had meetings during the afternoon. Today (Wednesday), I received a moneyclaim filing for an amount which appears to be equivalent to every invoice the client has ever received from my company. This appears frivolous at best.
The client has written on the moneyclaim form that I refused to give her website files back and that she does not believe we ever provided marketing services to her. I dispute both of these claims and the amount in full.
I would like to talk to a UK solicitor as to what to do next and preferably to resolving the dispute as per the letter from the client.
Notes about me: My company is small and turned over approximately £15,000 last year. My personal income was around £8000. I do not have a lot of money and have spent this evening being sick through stress and worry.
I hope that you can help me on a fixed fee or hourly basis. I am happy to offer any of my services as part payment as well should that be of interest.
