I have a small start up company. Some time ago we passed certain physical assets to another small limited company and put a formal agreement in place that they would redevelop those assets and re-launch the product.
Time passed and no progress was made and eventually they closed the company. Fortunately I had added an addendum to that contract which gave personal assurances from both directors that they would return or replace those assets should the company cease to trade (for whatever reason).
I have managed to recover some assets but in both cases have had to pay outstanding storage fees to have them released. In other cases I have not been able to find out where the assets are stored and therefore have lost these and the replacement cost has been the basis of my claim.
I have had email confirmation from one director blaming the other and willing to help me recover certain costs. I’ve had verbal promises from the other director to pay compensation but this has just been a delaying tactic. Last year I instructed a lawyer to review my case and they felt it was bullet proof and so a letter, threatening action was sent off. This led to further phone calls requesting time to settle, but to date nothing has progressed.
Unfortunately this lawyer has moved overseas and no longer able to represent me. I decided to complete a Money On Line application and the other party have now responded to dispute the claim.
I would like to provide the paperwork to a new lawyer/solicitor and discuss my options to progress this to a conclusion. I wait to hear how any bidder would charge, but imagine it would be a few hours to go through my papers and discuss on the phone…..further involvement would depend on that review.
