Band logo/image from existing copyrighted art

I've got an image that is copyrighted by the artist, and who I can't contact to get permission to use. I'd like something very similar with my band's name on the logo (Ruined Eye). I've attached the original image and my own version with band name - the name on mine is in dark blue, but I'd want it in black I've decided.

This is for the band website and also any other promotional material we use, such as t-shirts, posters, etc.
