Description
Experience Level: Expert
I have legal expenses cover via my policy with Hiscox.
Hiscox passed over the legal claim I want to lodge against a third party, to Arag insurance, which aquired DAS insurance a few years ago. Arag insurance, passed the claim to 'Arag Law', their own law firm, who have looked at the claim and even tough the merits of the claim have greater than 51% odds of success, they are still refusing cover because the companies public house records show that they only have £100 in the bank.
My claim is against three entities, which operate 13 venue's in London including the largest venue in Holborn, where most of the business took place and they owe a significant amount of money from unpaid fee's and they have breached their contract with us repeatedly, poaching clients, unjustly enriching themselves.
The parent company makes ALOT of money. These venue's bring in ALOT of money, yet, the insurance companies current position is that if a judgement was obtained, we wouldn't get the money, because of the public records from companies house which, is not an accurate representation of how we could recover monies owed.
Under the policy, I am allowed to get a second expert opinion to review the claim and dispute the decision, before escalating to the financial ombudsman if needed.
I am looking for a UK BASED legal representative, to help me navigate this project, knowing full well that if a judgement was secured against the defendants that, with freezing orders, the assets inside the venue's, stock, non money negotiated settlements through offsetting mechanisms from future events, it would actually be very easy for us to recoup what's owed to us.
PLEASE, no shady people outside the UK who have false promises. I need a genuine representative with legal knowledge, similar to that of a mckenzie friend, who isn't going to rip me off like a traidtional solicitors firm who could probably sort it out but if not sorted out, all the risk would fall on myself.
The claim has merits, the issue is they don't think that if a judgement came, we would get the money. I strongly, disagree.
If anyone has legal knowledge to help with this, has been through something similar or some other reasons sparks your interest, get in touch! There's no harm in having a chat to see what can be discussed.
PERFORMANCES RELATED RESULTS PLEASE. Make your own offers based on milestones of success. Do not say what you cannot deliver. Be expected to show proof of previous work or anything that supports your understanding of law in this area and please don't pop up trying to wing it. I am not in experienced, but this is a technical matter and I am looking to work with someone who can help me achieve more than what I could do independently.
The stakes are high, the legal expenses cover is there. My business is owed a SIGNIFICANT amount of money and with the right ADR, I think something could be worked out properly but on top of that, getting the value from the insurance policy we have a legal right to obtain is the main focus and secondary paths can be explored once that one has been exhausted using the remedies available to all policy holders like me.
I welcome and genuine offer to work on this project, all offers will be reviewed with respect and I will personally write to every enquiry to inform of a yes or no. DON'T BID UNLESS YOU ACTUALLY MEET THE CRITERIA AND HAVE THE BACKGROUND TO OFFER GENUINE SUPPORT. Thankyou.
I have over £500k in legal expenses cover.
I have set the project price as £300 as a guide for up front payment to look through the claim and strategise for the primary objectives but I remain open to alternative offers and paths and will look at everything strategically asseing it's commercial impact accordingly.
