We have won a small software development project (< £50k), it’s a fixed cost project with delivery milestones that have payments associated to them. We have a breakdown of all the activities, efforts and milestone that were used for project approval. We are urgently looking for somebody to put the heads of terms/SOW in a contract that has some protection for us. The biggest challenge we find ourselves, is when the customer endlessly is delaying us either on dependencies or testing. We obviously losing money by having resources assigned but have no way of contractually escalating and even associate some sort of penalty on delays. I am aware these things go both ways, so happy for the penalty regardless how small to be both ways.
