We are looking to lease a light industrial unit from our local council at the annual rent of £7000 on a 3 year lease. We are already in the premises on a tenancy at will basis but the council are keen for us to sign the lease. We have a copy of the lease which is 16 pages, the council owns many units exactly the same and it is a standard lease, which speaking to other unit holders they have just signed.
We would be keen however for a professional to read and review and advise on any nasty’s and provide suggested revisions to revert back to the council. We also need to be sure that the following are included within the lease, which have been agreed when negotiating with the council and need to be in the lease:
-Break clause every year with 3 months’ notice, allowing us to move out without any financial liability.
-Council covers all of its own legal costs, both for the lease and in future.
-Works have been carried out to the building to get us to move in, all is done except painting of outside roller shutter, this need to be stated in the lease so as it is done.
-Lease implies that on moving out we have to paint entire premises, we would prefer to return to condition as found rather than improving.
We require a professional to read and advise on the lease informing us of any unreasonable or arbitrary terms, provide revisions that we can revert back to the council with and provide revisions to cover the negotiated terms above.
