I am self-employed and run a new enterprise, one of my services is a scheme called ‘Build and Rent Back’. Basically a client commissions a web site (normally backed CMS type, or custom solution) and instead of paying up front, they just pay a weekly rental. I arrange hosting, and it is all charged as a service/licence.
I own the solution, responsible for backups, but the client owns the data, and is responsible for anything to do with it (data protection act etc).
I need a contract in English Law to cover this, and quickly – I need as fast a turnaround as possible. You should also be qualified in this area. I will also need the rights to the material, as I may amend and reuse it in future projects.
This is the context of how the scheme works:
"With upfront development costs normally stifling the creation of some great web based ideas, VirtualRIK.com aims to provide a solution where the design and build is facilitated in a ‘build and rent back’ scheme, eliminating any large setup costs normally bestowed on the client.
This ingenious solution allows the client to have a system built to their exacting requirements, then hosted for them with no development or support costs. The client always owns the data, and with no minimum term, gives them maximum flexibility.
How does it work?
Working with the client, VirtualRIK creates a scoping document to define all elements of the system, from who is going to use it, how data will be stored, through to output reporting etc. Within the scoping document an illustration of charges for the rent back scheme, along with estimated construction time is included.
Client signs off the specification and at this point pays a three month advance rental deposit (This covers the first three months rental, and is non-refundable).
Writing and testing of the solution commences. This includes any data cleansing required from the client for data to be prepopulated in the database.
A user guide is written for end users and once supplied to the client they have a short period to field test the product. VirtualRIK can even visit the clients premises and train colleagues either 1on1 or as a group.
Once the solution goes live, the customer receives a monthly invoice for the rental, plus any additional ancillary costs. (If a solution includes for example SMS support, there will be a cost per message etc).
The project then goes into a care and maintenance phase where VirtualRIK provides technical support for the solution, making weekly backups along with any agreed database management tasks.
Should the client wish to end service, they need only give one months’ notice, and at which point a data extract from the database is sent to the client, and the system is decommissioned."
