Hi,
I am a Landlord and currently going through a tenant counter-claim due to me issuing a Section 8 for tenant non-rent payment eviction. We have since dropped the Section 8 Eviction as the tenant made a payment however the Counter Claim still exists.
The tenants are claiming 50% of the rent back for the entire term of the tenancy due to a breach of quiet enjoyment. that is the clause they are using.
I am putting together a defence but would like some hard legal guidance, maybe case law, maybe legal tests for a breach of quiet enjoyment, maybe a judges guidance on how much and what constitutes quiet enjoyment, in order to defend the counter-claim please?
