Description
Experience Level: Intermediate
Legal topic: Property
Description of legal work: A brief outline of matters that relate to my situation are as follows.
I have had a longstanding boundary dispute with my immediate neighbour. This dispute was initiated by my neighbour in January 2014. On the 17 July 2015 my neighbour knocked down part-of the front-side fence. I called the police but they stated that it was a civil matter. On the 18 July 2015 my neighbour knocked down the remainder of the front-side fence. I retaliated and damaged a kitchen window and a windscreen on one of their cars. I was arrested. My neighbour stated that he had a survey (dodgy) which showed encroachment and that he had a right to knock down the fence. My fence builder states that the new front-side fence was in exact line with the old fence that was put up by the original owner of the land in the 1970s. I contest my neighbour’s assertion that he has a ‘right’ based on a survey that I was never consulted about and which was used for other purposes (i.e. to extend my neighbour’s property in Aug. 2014).
The criminal case against me was concluded at Hendon Magistrates Court on the 7 August 2015. I was given a conditional discharge and had to pay 400 pounds of costs and compensation.
I have tried to find freelance legal assistance on another site but the person who contacted me has failed to perform even a basic duty such as completing a written agreement between me and him, so I have terminated contact.
I respectfully request bids from independent legal practitioners who have experience of English County Court procedures and an understanding of disputes between neighbours. The person appointed must have professional indemnity insurance. I have offered mediation to my neighbour but this was never taken up.
Legal action required:
County Court Injunction to order my neighbour to replace the front fence that he has destroyed and to resolve the boundary dispute.
