It started when I queried the maintenance charge bill for the year 2020. I asked the management company to validate their bill by producing receipts and documents etc.
Although they consented to providing the documents, they never did.
In good faith, I decided to set up a standing order, paying them a set monthly amount until they produced the documents. Those receipts and documents never arrived.
In the meantime I sold the property at auction because of these problems. I had lost faith in the management company.
My conveyancing solicitor neglected to list the debt on the special condition of the auction terms, as it states in the general conditions that the seller must list any arrears on the special conditions if the buyer is expected to pay it. Although it is heavily stated all over the auction terms that the buyer is also assumed to have taken every precaution and due diligence to satisfy themselves of the condition of the property they're buying.
Now, after completion, the management company are suing me for the money, claiming that the buyer will not pay for the maintenance charge, that my name is still the registered name on the land registry because they blocked the buyer from registering the property as a result of the arrears.
Am I under legal obligation to pay? I have sold the property and this is after completion, the management company never validated the debt, am i still liable?.
For this job to meet my satisfaction, I will need you to review the documents and email correspondents, and prepare for a zoom meeting or video call to answer all my questions regarding my liabilities etc. You will need to be qualified legal practitioner in the field of commercial law and leasehold and auction contracts.
Payment after completion to be no later than 3 days.
