Description
Experience Level: Expert
I am seeking a solicitor experienced in Senior Courts Costs Office (SCCO) proceedings and solicitor-client cost disputes to conduct an independent review of a costs claim brought against me by a firm acting on a "no win, no fee" basis.
This is not about winning or losing in the traditional sense — I understand that costs judges often uphold CFA retainers, even in disputed situations — but I want to understand:
Whether my current defence has merit,
Whether my existing Points of Dispute should be amended or expanded,
What risks I face in terms of liability for the claimant's fees and court costs,
Whether it’s worth proceeding to the hearing or better to seek a settlement.
Key Documents Available for Review:
The CFA and retainer documents,
My Points of Dispute (filed as a litigant in person),
The Claimant’s Points of Reply,
Relevant correspondence, including their statutory bill and offers,
The SCCO Order dated March 2025,
The legal opinion from the insurer’s appointed firm (Lyons Davidson).
What I Am Seeking:
A fixed-fee review of the case file and a written opinion,
Advice on whether further representation is advisable and on what basis,
If appropriate, a fee quote for preparing an amended defence and/or attending any SCCO hearing.
I am not looking to contest every point — I want a straightforward and informed assessment from a lawyer familiar with costs disputes and CFA enforcement before making further decisions. Time is of the essence, as the hearing may be listed shortly.
Preferred Start: Immediate
Location: Remote welcome — documents available electronically
Budget: Open to discussion for fixed-fee review + staged follow-up costs if necessary
