Draft a Short Deed of Disclosure, Warranty, and Indemnity

I require a short, simple but legally binding, standalone Deed that forces absolute transparency over the exact amount of an inheritance.

Me and my ex partner are married and are about to enter into a financial/consent order. He has now disclosed a 5k inheritance which I am happy to let him keep. However, he initially failed to disclose an inheritance, having been actively advised by his parent to hide this from me, so I cannot trust his verbal word due to the prior deception.

The purpose of the document is to give him a clear, formal opportunity to reflect and confirm the truth of his disclosure before we submit the Consent Order.

Key Clauses and Elements to Include:
Declaration of Value: A straightforward statement where he confirms that the total inheritance received or due to be received from his grandparent's estate is exactly £5,000.00.

Warranty of Completeness: A legal promise that there are no planned, delayed, or deferred further payments to be made to him in connection with this Will or estate at a later date.

No Side Agreements: A sworn statement confirming there are no verbal promises, informal understandings, or side arrangements with family members or executors to hold back further money until our separation is legally finalised.

Right to Verify: A clause clarifying that while a copy of the Will is not being requested now, I reserve the absolute right to obtain a copy of the Will and estate accounts in the future if dishonesty is suspected.

3. Consequences of Breach
Automatic Financial Penalty (Clawback): If hidden funds or delayed payments from this estate are discovered later, I will be automatically entitled to a lump-sum payment equivalent to 100% of the hidden or undeclared balance

Legal Costs: A provision forcing him to fully pay all of my future legal fees and court costs if I am forced to take legal action to enforce this Deed or reopen the financial settlement due to an untrue declaration.

Execution as a Deed: The document must be structured as a short Deed to be signed in the presence of an independent witness, giving it heavy legal weight without requiring an aggressive tone.

Consequences:
Full Indemnity for Court and Legal Fees: A robust provision forcing him to fully pay 100% of all my future legal fees, solicitor costs, and court fees if I am forced to take him to court due to an untrue declaration.
