Hello,
The courier & depot (UK Mail, Poole) my business has been using was recently the subject of a Channel 4 documentary/ expose (Dispatches Secrets of your missing mail).
I lost £1000's of stock in damages and yet was never given any recompense. I have been offered a small payment in recognition of my complaint, but now seek legal council to help me put together a letter before action. This may then go to court, depending upon the offer made.
I believe I have proof that UK Mail broke their own contract in several instances and that they were operating in contravention of the Sales of Goods & Services Act.
I repeatedly complained to my account manager & local depot about items broken. This was frequently acknowledged, but no remuneration was ever received. There is some email evidence of their acknowledgement that I was due recompense. However the claims had to go through a specific channel (a telephone number which was answered only once in 20 + attempts).
As a result I do not believe that I was given adequate access to their procedure for damage claims, there was also a time limit to the submission of such claims - which was impossible to meet when they would not take my calls.
Furthermore; there is Channel 4 video evidence of the wilful mishandling & breaking of 100's of items in the Poole depot, also showing theft from broken consignments.
There are several other instances of the serious mismanagement of my account too. (items being collected but not shipped intentionally, no remuneration / access to the procedure for late items either & complaints raised not being followed up).
I seek someone to help who is experienced in such cases, to assist in a way which will enable me to proceed quickly. I have put this as a fixed price job, as I would like to pay a fixed price for the letter before action and will then discuss further terms when I receive their response. But I have no objection to being charged an hourly rate either, if reasonable.
regards
Nathan Burgess
