I have a loan contract for review, the governing law is English, and I need help answering some questions about money lending regulatory framework:
1. the loan contract in question is made between two individuals, the borrower is British but the lender is not. The loan is made from a friend to a friend based in the personal relationship. do loans between friend need special license or approval from a regulator before the agreement is made?
2. the contract states that the lender has a First Legal Charge over a property, does such charge need a registration? where?
3. the contact value is about GBP 200,000 and the purpose is to purchase a property by the borrower, if the lender is not authorized or licensed, would this challenge the enforceability of the contract in UK?
