I have been given 14 days to amend my ET1 form for a claim I have brought against my former employer.
I need to know the correct legislation see below:
47. The claimant also referred to whistleblowing in her claim form. She originally thought that the concerns that she raised regarding the under-performance of another employee (RF) on 15 February 2023 with her line manager and others amounted to a protected disclosure for the purposes of whistleblowing. We discussed the test for whistleblowing in detail (as set out in the draft list of issues that I sent to the parties before the preliminary hearing). The claimant was unable to state which of the categories in the whistleblowing legislation she believed this tended to show (e.g. breach of a legal obligation, breach of health and safety).
48. We therefore concluded that the claimant was likely to have referred to whistleblowing because she did not understand the legal requirements for whistleblowing legislation. However, the claimant has 14 days to comment on the updated draft list of issues and seek legal advice if she wishes to do so.
