Please review the tax treatment of a company purchase of own shares from a director selling shares.
The transaction has completed, the purchase price has been paid by the company, and the relevant Stamp Duty has been paid. The SH03 was submitted to HMRC and is currently awaiting HMRC processing/confirmation.

1. Whether the company purchase of own shares qualifies for capital treatment under CTA 2010 s1033, rather than being treated as a distribution.
2. The effective date of disposal for tax purposes, taking into account the date the share buyback agreement was entered into and the date the purchase price was paid.
3. Whether the director selling the shares qualifies for Business Asset Disposal Relief (BADR) in respect of the disposal.
4. Which tax year the disposal falls within and the applicable BADR/CGT rate.
5. How the disposal and BADR claim should be reported to HMRC, including what needs to be included within the director’s Self Assessment return and whether any action or reporting is required before that return is submitted.
