Experience Level: Intermediate
I own and run a small construction company. To date all of my 'employees' have been sub-contractors under the CIS. I recently took on a Site Forman under PAYE. He started beginning of March. We agreed terms with a formal offer but to date have never got round to getting a contract drafted or signed. I have decided that I don't want to keep the foreman as his performance is not good enough. He has had 3 weeks holiday since starting and numerous half days and the project he is running is behind schedule. He is currently on 2 weeks holiday and due to return on 31st July and I wish to hand him his notice effective immediately. He has a company vehicle as well as a phone and laptop. I just want to know what I am obligated to do. Must I give him a notice period? Will I owe him a Redundancy Payment etc? I plan to give him up to 2 weeks wages as a Severance Payment to avoid any issues down the line but don't want to give more than I need of course.
Can you help advise me?
I also wish to draft a contract for a new foreman I intend to hire starting in September.
