Hi,
Although I am a Brit, I am currently in NSW, Australia and employed here by an Australian university. It may be usual to have some knowledge of Australian Employment Law, although it may not be necessary as I believe the couple of questions I have are pretty generic.
I’m pregnant.
If I send you a copy of my contract can you read through it and answer these questions.
- I’ve been employed for 2 years, although I have recently moved from F/T to 4 days a week in a recent staff restructure.
I don’t believe it does, but does this alter anything in terms of maternity leave?
- I believe I am entitled to 6 months full pay of maternity leave. Correct?
- can I hand in my resignation whilst on my maternity leave? If I don’t return after the 6 months, will I have to pay back my maternity leave pay?
Anything else around not returning that I need to know?
- can I leave the country whilst on my 6 month maternity leave and will my company still pay me? Do I need to inform them?
Should it matter to them? What happens if I’m out of the country on keeping in touch days?
- there is an already existing enterprise agreement from 2018 that I can send you. They are reissuing one this year I believe (2022) does this impact my maternity leave or will it go off the 2018 one?
(I can send you the EA too).
Just looking for clarification on the above as I am considering a move back to England to support with the birth / newborn but don’t want my employer to know about it so don’t want to ask these questions directly to my HR dept.
