The study reveals that acquittal under the law of England and Wales communicates a spectrum of innocence and so functions on many levels despite performing a homogenous function “on the surface”. The current formulation of the acquittal increasingly accommodates complex undercurrents relating to the acquittal in that the acquittal has become more contestable but, as this study suggests, issues continue to pervade several major policy areas such as the insanity defence that have never been successfully addressed in policy terms in that some acquittals don’t properly “acquit” when they should, and some acquittals acquit when the acquittal conceals elements of malfeasance, or other pieces of relevant qualifying information that a more sophisticated acquittal system could and arguably should highlight. Some adjustments to the acquittal process in addition to those indirectly delivered through the Criminal Justice Act 2003 would achieve a fairer, more informative and generally more optimal acquittal process under the law of England and Wales, and it is not necessary to abandon the binary construction of the acquittal process in order to achieve this since the binary acquittal system already recognises different types of acquittals albeit this system fails to communicate enough information....".
