Hello I am looking for some qualified advice on an issue of “intellectual property law”. I am a small business owner and I registered a Ltd company in the UK in 2007. The bank account was also set up and used. In a very short time later I had found that a Multi national company (Firestone) had introduced a product into the UK with the same name as my registered Ltd company. I have a roofing company, their product is a flat roofing product. My company name was not trademarked. Their advertising of product absolutely sank the position I had on google etc due to the ferocity of their campaign. I’d had letters from their UK solicitors accusing me of infringement but my representatives proved them to have no case down to dates of registering etc. My question is… Is there a way forward legally against the company or is it a case of live with it? I am looking for sound and solid advice. EDIT>> I feel ive not been clear in the description, The case that was brought against me by interlectual property law was for "passing off", of which was proven unfound by a solicitor I used.
