Description

I purchased a car on 26/5/2018. The dealership refused to let me test drive the car and needed me to pay deposit in ordered to test it. After I paid it and came back later, he said I would need to pay the full amount. After I paid the full amount, he just gave the car to me and said you could drive off. I discovered that there was an engine problem straight away and he said it was just carbon build up and it would clear after a few days. I went to a garage I used, and that person said get it refunded because the engine had a lot of problems. I contacted the dealership and he said he didn't do refund, but he would repair everything for free. Then he texted me a postcode and didn't give me the name of the garage. No matter how I phoned him or texted him he didn't reply. So, I went to the post code and repair the car on about 3/6/2018. Then I need to fly back to my home country on 21/6/2018 but the repair work had not been done yet. The car was being kept all the time. I came back in August and contacted the repairing people on 24/8/2018. However, I could not contact them for more then a month even I went there. After that, I told the dealership and schedule a date to go to the repairing garage together. On 3/10/2018, we arrived that garage, he said that garage was not the one he told me to go to. That time the owner of the repairing garage was there. The owner said we needed to pay £1900 for repairing and £1244 for storage. The car still has at least £3000 to repair. The dealership said if we didn't pay, the car would be sent to auction or he would pay that amount of money but needed me to sign a contract which stated that both parties would not have further contact or legal process. He also said it had been over 30 days and he wouldn't do refund and he lost money already and he wouldn't pay for further repairing. As the repairing garage would put the car to auction soon, I had to get the car back as soon as possible to avoid keep paying for storage or being sent to auction. He was just tricking me to accept his offer of partly repairing the car or otherwise, the car would be sold in auction. I signed the contract. Until the day after, I phoned citizen advice and they told me I had the right to get the vehicle repaired fully at no extra cost and within a reasonable amount of time or have a full refund. By that time, I knew I was tricked to sign that contract and therefore, I want to claim for a full refund.

Hi There
This is a rather complex issue and it is unfortunate that you did sign the contract. I can help you put a claim refund letter together, but my advice is that you seek legal representation. These guys probably have experience scamming customers and a letter from a law office will show them that you are serious. Best of luck.
