DEFENCE WORK
COURSEWORK BRIEF
You, working on behalf of defence, have been given a package of evidence items, documents and paperwork for
the case of
R v Sherman Hollander
who is charged with committing an offence under the
Computer Misuse Act 1990 s. 3A(1), which states that
“A person is guilty of an offence if he makes, adapts, supplies or offers to supply any article intending it
to be used to commit, or to assist in the commission of, an offence under section 1 or 3.”
As the defence’s expert witness, your role here is to advise as to whether:
a) There is forensic soundness in all processes used by the prosecution’s digital forensics investigators
b) To forensically analyse the contents of the evidence files provided (with documentation and in
adherence to the ACPO Principles and relevant legislation) to determine whether
a. The case would be admissible in court
b. If the case is admissible, whether the accused, Mr Sherman Hollander, shall plead guilty or not
c. And if Mr. Hollander should not plead guilty, on what grounds would this be based on
evidentially.
