I rented a property in November 2017. Landlord got me to sign tenancy, but did not give me a copy. I paid £550 deposit and rent paid in advance each month on 1st of the month.
I had told him from the start that would sub-let some rooms and I wanted to store some of my excess items there. He didn't mind as long as I paid my rent.
I soon found out that there was a huge damp problem. He kept denying it, saying it was just that the plaster had not dried out yet. (It was a newly renovated property)
I found him inside my property several times and he turned on the central heating to try to dry the walls out. I changed the locks to stop him entering my property.
In April I got him to sign a letter I prepared confirming that I was renting the property, he had taken £550 deposit, all my rent was up to date and I had permission to sub-let it. I also got him to examine the condition of the property and to confirm in the letter that he would not make any deductions from the deposit. He reluctantly signed it. I also had a witness to witness it.
He told me he wanted me to leave ASAP and I said he had to serve notice and I would leave when I found another place.
I intended to return the property around 10th June, and I informed him. I told him I wanted my full deposit back. I had moved most of my things out and all the lodgers had left. The next day he used a locksmith to change the locks and take possession back. I made a 5 minute video of him doing this, as I used my key to enter and told him this was illegal as he had not served notice, neither had I. I had just verbally said I had plans to leave as the property was damp.
I also found out that he was not allowed to rent it as the council had not signed off as habitable. They were waiting for the damp certificate.
What I require:
Letter before action regarding
(1) he did not register the deposit (I want to claim 3x £550) plus my deposit back
(2) the Illegal eviction and my damages
(3) return of the entire rent I paid as the house was uninhabitable
file the papers for the small claim court action. I will attend the court myself but will just need advice before the court date
please quote separately and for the whole matter
